Welcome to the Air Candies Affiliate Program! By joining our program, you agree to abide by the following terms and conditions. Please read them carefully to ensure you understand your rights and responsibilities as an Air Candies affiliate.

1. Acceptance into the Program

  • Application Review: All affiliate applications are subject to review and approval by Air Candies. We reserve the right to reject any application for any reason, including, but not limited to, content incompatibility or insufficient audience size.
  • Eligibility: You must be at least 18 years of age and have a valid PayPal or bank account for commission payments.

2. Affiliate Responsibilities

  • Promotion: You agree to promote Air Candies products using the marketing materials and affiliate links provided. You will ensure that your promotions are ethical, accurate, and in line with Air Candies’ brand values.
  • Compliance: You agree to comply with all applicable laws, regulations, and guidelines, including the Federal Trade Commission (FTC) guidelines on endorsements and testimonials.
  • Content Ownership: You retain ownership of your content but grant Air Candies the right to use, reproduce, and distribute your promotional content for marketing purposes.

3. Commissions

  • Commission Rate: Affiliates earn a commission based on their rank, ranging from 10% to 25% on all qualifying purchases made through their unique affiliate links.
  • Self-Purchases: Affiliates can earn commissions on their own purchases made through their unique links.
  • Payment Schedule: Commissions are paid out on a monthly basis. Payments are made through PayPal or bank transfer, as specified during the sign-up process.
  • Refunds and Chargebacks: Commissions will not be paid on orders that are refunded or result in chargebacks.
  • Commission Adjustments: Air Candies reserves the right to adjust commission rates and structures. Affiliates will be notified of any changes, which will apply to future sales.

4. Marketing Materials

  • Usage: Affiliates have access to a variety of marketing materials, including banners, product images, and promotional content. These materials are to be used solely for promoting Air Candies products.
  • Modifications: Affiliates may not modify the marketing materials provided by Air Candies without prior written consent.
  • Brand Guidelines: Affiliates must adhere to Air Candies’ brand guidelines when using marketing materials to ensure consistent and accurate representation of the brand.

5. Prohibited Activities

  • Spam: Affiliates are prohibited from engaging in spam or unsolicited email marketing.
  • Misrepresentation: Affiliates may not misrepresent Air Candies products or make false claims.
  • Inappropriate Content: Affiliates may not promote Air Candies on websites or platforms that contain inappropriate content, including but not limited to, adult content, violence, discrimination, or illegal activities.
  • Fraudulent Activity: Any fraudulent activity, including but not limited to, self-referrals, fraudulent sales, and manipulation of the system, is strictly prohibited.

6. Termination

  • Termination by Affiliate: You may terminate your participation in the Air Candies Affiliate Program at any time by notifying us in writing.
  • Termination by Air Candies: Air Candies reserves the right to terminate your participation in the program at any time for any reason, including violation of these terms. Upon termination, all outstanding commissions will be forfeited.
  • Effect of Termination: Upon termination, you must immediately cease using all Air Candies marketing materials and remove all affiliate links from your website and platforms.

7. Limitation of Liability

  • No Liability for Indirect Damages: Air Candies will not be liable for any indirect, special, or consequential damages arising in connection with the affiliate program.
  • No Warranties: We make no express or implied warranties or representations with respect to the affiliate program or any products sold through the program.
  • Indemnification: Affiliates agree to indemnify and hold harmless Air Candies from any and all claims, damages, liabilities, and expenses (including legal fees) arising out of their participation in the program.

8. Modification of Terms

  • Right to Modify: Air Candies reserves the right to modify these terms at any time. Affiliates will be notified of any changes, and continued participation in the program constitutes acceptance of the new terms.
  • Notification of Changes: Affiliates will be notified of changes to these terms via email or through an announcement on the affiliate dashboard.

9. Governing Law

  • Jurisdiction: These terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles.
  • Dispute Resolution: Any disputes arising out of or related to these terms shall be resolved through binding arbitration in Wisconsin, in accordance with the rules of the American Arbitration Association.

10. Confidentiality

  • Confidential Information: Affiliates may have access to confidential information, including but not limited to, sales data, marketing strategies, and product information. Affiliates agree to keep all such information confidential and not disclose it to any third party.
  • Non-Disclosure Agreement: Affiliates may be required to sign a Non-Disclosure Agreement (NDA) to participate in certain aspects of the program.

11. Intellectual Property

  • Trademark and Copyright: Affiliates may use Air Candies’ trademarks and copyrighted materials solely for the purpose of promoting Air Candies products. All such usage must comply with Air Candies’ brand guidelines.
  • Proprietary Rights: All intellectual property rights in and to Air Candies’ marketing materials and products remain the exclusive property of Air Candies.

12. Miscellaneous

  • Independent Contractor: Affiliates are independent contractors and not employees or agents of Air Candies. Nothing in these terms shall be construed to create any partnership, joint venture, or agency relationship.
  • Entire Agreement: These terms constitute the entire agreement between Air Candies and the affiliate and supersede all prior agreements and understandings, whether written or oral.
  • Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: The failure of Air Candies to enforce any provision of these terms shall not constitute a waiver of that provision or any other provision.
